Terms & Conditions

These terms explain how businesses and authorised users may access and use the platform across loans, collections, communications, reports, and related lending workflows.

1. Agreement to Use the Service

These Terms & Conditions govern access to and use of Nfunayo. By registering, subscribing, logging in, or using the platform, you agree to be bound by these terms.

If you are using the service on behalf of a business, SACCO, lending company, or other organisation, you confirm that you have authority to act for that organisation.

2. What the Platform Provides

Nfunayo provides tools to manage lending operations, including customer and guarantor records, collateral, loan creation, repayment tracking, collections, reports, exports, communication reminders, and user permissions.

We may improve, change, add, or remove features from time to time as part of ongoing product development, maintenance, and security improvements.

3. Accounts and Access

You must provide accurate information when creating and maintaining an account. You are responsible for safeguarding your login credentials and for all activity that occurs under your users, branches, and staff accounts.

You are also responsible for keeping your account users appropriately authorised, trained, and managed, especially where sensitive borrower or payment information is involved.

4. Customer Data and Business Responsibility

You retain responsibility for the legality, accuracy, and appropriateness of the data you enter into the platform, including borrower information, guarantor details, collateral records, payment history, and communications sent through your workflows.

You agree not to use the platform for unlawful lending activity, fraudulent conduct, harassment, unauthorised messaging, or any activity that violates applicable data protection, financial, consumer, or communication laws.

5. Subscriptions, Billing, and Trials

Some parts of the service may be offered on a trial or paid subscription basis. Plan limits, trial periods, pricing, and billing details are presented on the pricing or billing pages in effect at the time of signup or renewal.

If your plan requires payment, you agree to pay applicable fees on time. We may suspend or limit access where fees remain overdue, subject to any grace periods or notices we choose to provide.

6. Communications and Integrations

Where the platform allows SMS, email, or other reminder workflows, you are responsible for the legality, timing, content, recipient accuracy, and consent requirements connected to those communications.

Third-party providers may be involved in sending messages, processing payments, or supporting infrastructure. Their services may also be subject to their own terms and policies.

7. Availability, Backups, and Support

We work to keep the platform reliable and secure, but we do not guarantee uninterrupted or error-free availability at all times. Maintenance, outages, provider failures, security incidents, or events outside our control may affect access.

Businesses should maintain appropriate internal controls and, where necessary, keep their own copies of critical exported or operational records for compliance and continuity purposes.

8. Intellectual Property

The platform, software, design, branding, documentation, and underlying systems remain the property of Nfunayo and its licensors, except for data you or your business submit to the service.

You may not copy, reverse engineer, redistribute, resell, or misuse the platform except as permitted by law or with our written approval.

9. Suspension and Termination

We may suspend or terminate access where we reasonably believe there is misuse of the service, a security risk, unlawful conduct, unpaid subscription obligations, or a material breach of these terms.

You may stop using the platform at any time. Suspension or termination does not remove obligations that arose before the account was closed.

10. Liability and Governing Law

To the fullest extent permitted by law, the service is provided on an as-available basis and we are not liable for indirect, incidental, special, or consequential loss, including loss of profits, revenue, or data arising from use of the platform.

These terms are governed by the laws of Uganda unless another mandatory legal framework applies to a specific relationship or transaction.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the platform after updated terms take effect means you accept the revised version.
